Des usages intempestifs de l'expression « droits collectifs »

Abstract:
The expression « collective rights » is found time and again in contemporary political discourse. However, this same expression does not lend itself easily to a clear legal definition. This difficulty in defining such an expression flows from an internal contradiction .from a legal point of view, we can only speak of individual rights, even though those rights might be exercised by a moral entity. This paper offers both a taxinomy of « collective rights » and a refutation of the utility of any of these uses within a legal context.
